La Corte Suprema de Panamá declara inconstitucional la concesión de puertos a una compañía de Hong Kong

El presidente de Panamá, José Raúl Mulino, anunció este viernes que una subsidiaria del grupo AP Moller – Maersk asumirá transitoriamente la operación de los puertos de Balboa y Cristóbal, en ambos extremos del Canal de Panamá, luego de que la Corte Suprema del país declarara inconstitucional el contrato de concesión para ambas terminales a una empresa de Hong Kong.

La Corte informó en un comunicado este jueves que declaraba inconstitucionales el contrato, sus adendas y un acto de prórroga entre el estado panameño y la sociedad Panama Ports Company, subsidiaria del conglomerado chino CK Hutchinson Holding.

En un mensaje grabado y compartido a los medios de comunicación, el presidente Mulino dijo que desde hace un año se preparó un plan de contingencia ante las posibles decisiones de la Corte y explicó que, luego de que el fallo quede ejecutoriado, hay un tiempo de transición para la salida de Panama Ports de los puertos de Balboa y Cristóbal.

“Esperamos que la empresa, miembros de Hutchinson Ports y filial del multinacional CK Hutchinson Holding, con presencia global y celosa de su reputación corporativa, coopere abiertamente en esta etapa”, expresó Mulino.

El mandatario garantizó los derechos que por ley le asisten a la empresa y aseguró que será fiscalizador de las obligaciones contractuales. Además, a los trabajadores les anunció que “no se producirán despidos”, mientras que los contratistas tendrán la continuidad vigente.

Mulino aclaró que la empresa AP Moller – Maersk (APM Terminals) asumirá hasta que haya una nueva concesión, luego de un proceso abierto y participativo “que defienda los intereses de los panameños”.

A través de un comunicado, APM Terminals confirmó lo anunciado por Mulino.

La empresa “está dispuesta a asumir temporalmente la operación de ambas terminales. Esto busca mitigar los riesgos que puedan afectar los servicios esenciales para el comercio regional y global, y apoyar el hub logístico de Panamá”, dice el comunicado de la compañía, que opera 60 terminales en 34 países.

“La compañía no es parte de los procesos legales en curso ni participa en decisiones sobre la estructura y administración futura -a corto o largo plazo- de los puertos de Balboa y Cristóbal”, explicó la firma.

En respuesta al fallo de la Corte, Panama Ports aseguró en comunicado de que no había sido notificada, y que el fallo es el resultado de “una campaña del Estado panameño” impactando a la empresa y a su inversionista por más de un año, luego de 28 años de operaciones en el país, tiempo en que, dice, han invertido más de US$ 1.800 millones.

Panama Ports reclamó que el fallo “carece de fundamento jurídico” y que “la campaña del Estado panameño contra su propio marco jurídico y contractual, así como contra un concesionario e inversionista diligente, continúa socavando la reputación de Panamá como una jurisdicción confiable”.

Al respecto, la empresa anunció que, junto a su inversionista, se reservan todos los derechos de manera permanente, incluyendo recurso a procedimientos legales e internacionales.

El fallo se produce un año después de que la operación de los mencionados puertos fueran, durante meses, motivo de tensión entre los gobiernos de Panamá y Estados Unidos, luego de que el presidente Donald Trump dijera que recuperaría el Canal de Panamá porque había “influencia maligna china” en la vía interoceánica, lo que ha sido negado por los Gobiernos de Panamá y China.

Iran is open to US talks but won’t be dictated to and won’t negotiate on missiles, foreign minister says

(CNN) — Iran is ready to participate in “fair and just” nuclear talks with the United States amid rising tensions between the two nations, but will not be dictated to, Iranian Foreign Minister Abbas Araghchi said Friday.

“We are under no circumstances willing to accept dictation or imposition,” Araghchi said at a press conference during a visit to Istanbul alongside Turkish Foreign Minister Hakan Fidan. “Nevertheless, Iran is ready to participate in any diplomatic process that is meaningful, logical and fair.”

It is not clear when or in what format the potential talks could occur. Araghchi said no meeting with the US has been arranged while cautioning that such talks cannot be “conducted under threat.”

He also ruled out the possibility of Tehran engaging in negotiations about what he called Iran’s “defensive capabilities,” as well as its missile programme. “I believe no country is prepared to compromise on its own security or its national defence,” he said.

The announcement follows renewed threats from Washington, with US President Donald Trump urging Iran on Wednesday to sign what he called an “equitable” nuclear deal or face another potential US military strike.

Trump said Thursday he’s been having conversations with Iranian leaders and is planning on further discussions.

“I have had and I am planning on it,” he said when asked about the status of his conversations with Tehran. “We have a lot of very big, very powerful ships sailing to Iran right now, and it would be great if we didn’t have to use them.”

Trump did not say to whom he spoke, but he did describe the message he conveyed. “I told them two things,” Trump said. “Number one, no nuclear. And number two, stop killing protesters.”

Thousands of demonstrators were killed during recent anti-government protests in Iran after a heavy clampdown by the Iranian regime.

Araghchi said Friday that Iran is “ready to re-enter the nuclear negotiations” while reiterating Tehran’s long-standing position that his country’s nuclear programme is for peaceful purposes.

“The necessary preliminaries must first be established – concerning the format, the venue and the agenda of the discussions,” he added.

Turkey ready to help de-escalate

During Araghchi’s trip to Istanbul, Turkey said it was ready to “assume a facilitating role” between Iran and the US to help de-escalate tensions.

The offer was made in a call between Turkish President Recep Tayyip Erdogan and his Iranian counterpart Masoud Pezeshkian, the Turkish presidency said.

“The leaders discussed Turkey-Iran bilateral relations and the escalating military tensions in the region,” the Turkish presidency said in a statement Friday.

On arrival to Istanbul, Araghchi accepted that regional issues are “extremely serious at the moment and we are facing major challenges.”

“The goals stated by the United States and others make it necessary for us to hold closer consultations, review regional developments and coordinate our positions,” Araghchi told reporters.

Luigi Mangione will not face death penalty, judge rules

New York (CNN) — Luigi Mangione will not face the death penalty for allegedly killing UnitedHealthcare CEO Brian Thompson in December 2024, a federal district judge ruled.

The decision is a loss for federal prosecutors, who were adamant about pursuing the death penalty in the case.

The judge dismissed the murder charge because it requires that the killing was committed during another “crime of violence.” Prosecutors alleged the other crimes of violence were two stalking charges, arguing Mangione stalked Thompson online and travelled across state lines to carry out the killing.

The judge disagreed, finding stalking charges are not “crimes of violence” and dismissed two counts in his federal case – murder and a related firearm offense.

The murder charge is the only count in Mangione’s federal indictment that could have carried a possible death sentence.

Mangione will still face two counts of stalking. If convicted, those counts have a maximum sentence of life in prison without parole.

Jury selection for the federal trial is scheduled to begin on September 8, with opening statements starting on October 13.

Judge Margaret Garnett also ruled Friday to allow into Mangione’s trial evidence recovered from his backpack at the time of his arrest.

Law enforcement seized several items from Mangione’s backpack, including a handgun, a loaded magazine and a red notebook – key pieces of evidence that authorities have said tie him to the killing.

Mangione’s attorneys had argued for the evidence to be barred from trial, contending the search of their client’s backpack was illegal because they had not yet obtained a warrant and there was no immediate threat to justify a warrantless search.
