EU’s ‘yes means yes’ rape definition seeks to close loopholes allowing rapists to walk free

London (CNN) — European lawmakers have voted in favor of defining sex without active consent as rape, marking a historic step for women’s rights and survivors of sexual violence in the EU.

The European Parliament’s resolution, passed on Tuesday by an overwhelming margin, urges all EU member states to adopt an only “yes means yes” legal standard for consent while recognizing that a “yes” obtained through coercion is not valid.

The move seeks to replace the traditional “no means no” principle, which activists argue fails to protect victims by not requiring explicit, affirmative consent for sexual acts.

The resolution is the just the first step in the political process: It will now need to be proposed as legislation for EU member states to vote on.

Dutch MEP Anna Strolenberg said that “a society that truly respects women does not ask whether they resisted enough, it asks whether they freely agreed.” She told CNN, “No one can consent while asleep, drugged, unaware or paralyzed by fear. Any law that leaves room for this doubt, leaves room for violence,”

At present, rape laws in Europe generally follow one of two models – consent-based, which considers rape a sexual act without consent, or coercion-based, which requires a sexual act to have taken place by force. Twenty-one of the EU’s 27 member states have adopted consent-based rape laws, according to Amnesty International, and in some, including Sweden and Spain, the law follows the “yes means yes” approach. Meanwhile, in countries like Hungary and Latvia, the law generally requires proof of use of force, threats, or coercion.

Those legislative gaps create significant hurdles for survivors, experts say, as it requires them to prove the use of violence or threats.

French MEP Manon Aubry said in a debate ahead of the vote that laws that do not recognize the importance of active consent allow “perpetrators to have full impunity.”

In October 2025, France, after years of opposition, updated its criminal code to explicitly define rape as any sexual act committed without consent. The move followed a public reckoning in the wake of the landmark Pelicot trial, where 50 men were charged with the mass rape of Gisèle Pelicot, whose ex-husband Dominique Pelicot drugged her, and organized her rapes with men he met online.

“Important step” in fight against “rape culture”

A series of similar, high-profile drug-facilitated sexual abuse (DFSA) cases have also come to light in Europe. In December, a German man was found guilty of drugging and raping his unconscious wife over several years and filming the assaults.

While European lawmakers have historically struggled to agree on a unified, EU-wide definition of rape, Irish MEP Maria Walsh said that CNN’s recent reporting on an online “rape academy” has accelerated the debate.

CNN’s discovery of a Telegram group, where nearly 1,000 men shared step-by-step instructions on drugging and assaulting their partners, and which was part of a wider network of non-consensual image sharing, underlines “why a European-wide response is so badly needed” when it comes to prosecuting sexual assault, Walsh said.

Amnesty International’s Dinushika Dissanayake welcomed Tuesday’s resolution, saying that it was an important step in the fight against “rape culture,” which is underpinned and perpetuated by harmful myths and gender stereotypes, (and) attempts to normalize and even justify sexual violence in our societies.”

One in six women in the EU experience sexual violence in adulthood, according to Amnesty, with one in 10 women raped in their lifetime.

New Signal Light Installed to Manage Hwy 101 Construction Traffic

SANTA BARBARA, Calif. (KEYT) - A new temporary signal light is now working on Coast Village Road in Santa Barbara where the northbound freeway traffic exits at Hermosillo.

This is part of the traffic management plan for the Highway 101 improvement project in the area.

Recently, the northbound exit nearby at Cabrillo Blvd. was closed, and traffic is now exiting the freeway at Hermosillo which is a shorter off ramp.

It comes out at Coast Village Road west of Butterfly Lane and Coast Village Circle.

Additions include a new crosswalk there.

The Coast Village Association says it was not aware of the light installation recently and sought information for its members, who are property owners and businesses.

The signal was first in place and on blinking red before it was switched to the normal sequence. A pedestrian crosswalk button is also expected to be added.

There were traffic concerns and congestion issues reported last Friday in that area.

Exclusive: Justice Department indicts former FBI Director James Comey for a second time

Former FBI Director James Comey has been indicted a second time by Trump’s Justice Department

(CNN) — Former FBI Director James Comey was indicted Tuesday over a photo of seashells officials said threatened President Donald Trump, marking the administration’s second attempt to prosecute one of his largest political opponents, three sources first told CNN.

Trump has long pressed for his political adversaries to face charges, including the former FBI director he sees as a key leader in the perceived effort to “weaponize” justice system against him.

Last May, Comey posted a photo on social media of shells on a beach writing out the numbers “86 47,” which critics said referred to taking out or killing Trump.

When used as slang, the number 86 can refer to getting rid of or tossing something out. Trump is currently the 47th president. Comey posted the photo of the shells, writing in the caption “Cool shell formation on my beach walk.”

Almost immediately following his post, Republicans and administration officials went full bore in their criticism of Comey at the time, with then-Department of Homeland Security Secretary Kristi Noem announcing Comey would be investigated by the Secret Service over what she said was a call “for the assassination” of Trump.

The Secret Service brought Comey in for an hours-long interview with agents in Washington, DC, an uncommon step by the agency over a non-specific threat. Comey told investigators he saw the shells on a beach in North Carolina.

Director of National Intelligence Tulsi Gabbard told Fox News following Comey’s post that the former director should be “put behind bars for this” and that she was “very concerned” for Trump’s life.

Comey removed the post the same day, writing on social media that he assumed the shells represented “a political message” but “didn’t realize some folks associate those numbers with violence.”

“It never occurred to me but I oppose violence of any kind so I took the post down,” he wrote.

Legal and security experts have told CNN such a case against Comey may be fruitless, especially given the country’s free speech protections.

A second indictment

The case against Comey marks a newly reinvigorated effort by Trump’s Justice Department to convict the former director, who became a staunch critic of the president following his firing by Trump in 2017 over the Russia-meddling investigation.

In September of last year, the Justice Department first brought charges against Comey, accusing him of lying to Congress over leaks to the press. The case was dismissed late last year by a federal judge who found that the interim US Attorney for the Eastern District of Virginia had been improperly appointed, having skirted approval from the Senate.

Comey’s attorneys declined to comment for this story.

The former director fell out of favor with Trump before he was first elected president, as Comey’s agency investigated the Trump campaign and ties to Russia. Comey was fired in the months after the inauguration.
