La Corte Suprema prohibió este martes al presidente Donald Trump desplegar la Guardia Nacional en Chicago para proteger a los agentes del Servicio de Inmigración y Control de Aduanas (ICE, por sus siglas en inglés), lo que representa una rara derrota para la Casa Blanca en el alto tribunal, mientras el presidente ha intentado enviar militares a varias ciudades de Estados Unidos.

“En esta etapa preliminar, el Gobierno no ha identificado una fuente de autoridad que permita a las Fuerzas Armadas ejecutar las leyes en Illinois”, señaló la corte en su orden no firmada.

Los jueces conservadores Samuel Alito, Clarence Thomas y Neil Gorsuch discreparon de la decisión.

La ley federal permite que un presidente federalice la Guardia Nacional cuando ya no puede ejecutar las leyes de Estados Unidos con fuerzas regulares. Durante el caso surgió un debate sobre si ese término, “fuerzas regulares”, se refiere a las Fuerzas Armadas o a todos los agentes federales, como los del Servicio de Inmigración y Control de Aduanas.

En su orden, la corte indicó que el término “probablemente” se refiere a las Fuerzas Armadas. Además, señaló que la facultad de federalizar la Guardia Nacional bajo la ley que Trump intentó invocar “probablemente solo aplica cuando las Fuerzas Armadas pueden ejecutar legalmente las leyes”. Es decir, de acuerdo con la corte, no aplica para proteger a agentes que hacen cumplir las leyes migratorias.

“Por lo tanto, al menos en este contexto, el Gobierno no ha demostrado que la ley en cuestión permita al presidente federalizar la Guardia Nacional en ejercicio de la autoridad inherente para proteger al personal y la propiedad federal en Illinois”, indicó la corte.

El juez Brett Kavanaugh, conservador que apoyó la decisión de fondo de la corte, dijo que lo habría hecho en términos más limitados. Coincidió en que el término “fuerzas regulares” significa las Fuerzas Armadas de EE.UU.

“La interpretación legal de la corte, según la entiendo, podría tener implicaciones significativas para futuras crisis que ahora no podemos prever”, dijo Kavanaugh.

Alito, respaldado por Thomas, escribió que “discrepa firmemente” con la forma en que la corte abordó el caso.

“La corte no explica por qué la autoridad constitucional inherente del presidente para proteger a los funcionarios y bienes federales no es suficiente para justificar el uso de miembros de la Guardia Nacional en el área relevante para ese propósito”, escribió Alito. “No estoy preparado en este momento para expresar una opinión definitiva sobre estas cuestiones, pero tengo serias dudas sobre la corrección de las opiniones de la corte”.

Alito argumentó que sus colegas “no tienen base para rechazar la determinación del presidente de que no podía ejecutar las leyes federales de inmigración utilizando los recursos de las fuerzas del orden civiles a su disposición”.

“Cualquiera sea la opinión sobre la aplicación de las leyes de inmigración del Gobierno actual o la forma en que ICE ha realizado sus operaciones, la protección de los funcionarios federales ante ataques potencialmente letales no debe ser obstaculizada”, escribió Alito.

La decisión de la corte, que llegó dos meses después de que el Gobierno de Trump presentara su apelación de emergencia, se produjo cuando las tensiones en una instalación de ICE al oeste de Chicago parecían haberse reducido. El Gobierno informó a un tribunal federal en otro caso, semanas atrás, que la “mayor coordinación” con la policía local había “reducido la necesidad de que los funcionarios federales” interactuaran con manifestantes en el edificio de Broadview, en los suburbios.

(CNN) — Emergency crews are responding to a mass casualty incident at a Pennsylvania nursing home after a reported fire and explosion, fire and police officials say.

The Silver Lake Nursing Home is located about 20 miles northwest of Philadelphia in Bristol Township.

It is not immediately clear if there are injuries and the situation is ongoing.

This is a developing story and will be updated.

CHP set to begin two-day holiday enforcement period

SANTA MARIA, Calif. (KEYT) - The California Highway Patrol (CHP) is getting ready to hold its two-day long holiday enforcement period beginning Wednesday evening.

The 30-hour patrol effort will start 6 p.m. on Wednesday, December 24 and end at 11:59 p.m. on Thursday, December 25.

During that time, CHP officers will be out in full force on highways throughout the state looking in particular for drivers who are suspected of driving impaired or are speeding.

"Every instance of speeding or reckless driving carries the potential for life-changing consequences," said CHP Commissioner Sean Duryee. "Our officers see the destruction these choices can cause, and we urge every driver to slow down, stay alert, and make decisions that protect themselves and others. No destination is worth risking a life."

According to the CHP, during last year’s Christmas holiday enforcement period, its officers arrested over 300 impaired drivers, issued 2,251 speeding tickets, including 132 to motorists going over 100 mph.

CHP added in the same period of time, there were at least 17 people were killed in car crashes across the state.

With a significant storm set to hit much of California during the holiday enforcement period, CHP is asking motorists to be extra cautious while driving during inclement weather.

The CHP is urging drivers to slow down, allow extra following distance, and remain alert for road hazards such as standing water, rockslides, mud, or icy pavement.

Rippin’ Hard Wind Will Add to the Holiday Weather Woes

SANTA BARBARA, Calif. (KEYT) - Winds gusts in excess of 50 miles per hour could be pummeling the Central Coast and drastically change Christmas Eve plans for many people on the Central Coast.

Forecasters in the First Alert Weather Center say the hardest period of rain for starters will bear down on the area in the early morning hours, Wednesday.

Already some trees have been coming apart with the leading edge of a long, stretched out path of rain and forceful wind going back across the Pacific to Hawaii. Debris is falling on Cabrillo Blvd. on the Santa Barbara waterfront.

The storm is not a surprise. It was seen developing more than a week ago.

Warnings have been issued over the last few days, and that has sped up travelers who are driving if they can leave earlier. The dry roads will end by tonight. The rain may not be fully gone until Saturday.

Boat owners who are not docked in the Santa Barbara harbor have been advised to come in from the nearby anchorage to the east of Stearns Wharf.

The Santa Barbara Tuesday Farmers Market has made adjustments to end about an hour early with farmers selling on what is a popular day, only from 3 p.m. to 5:30 p.m.
