El fondo contra la “instrumentalización de la Justicia” de Trump enfrenta otro desafío legal

El fondo de casi US$ 1.800 millones, creado recientemente por el Gobierno de Trump para aliados del presidente que dicen haber sido atacados injustamente por el Gobierno, recibió una segunda demanda este viernes, sumándose a la creciente reacción legal y política que enfrenta la Casa Blanca.

Este viernes, un grupo diverso de personas y organizaciones —incluidos un exfiscal federal y un destacado grupo de vigilancia gubernamental— pidió a un juez en Alexandria, Virginia, que bloquee al Gobierno de Trump de distribuir cualquier cantidad de dinero, argumentando que el fondo es inconstitucional y viola una serie de leyes federales.

Entre los demandantes del caso están Andrew Floyd, un exfiscal federal que trabajó en casos penales presentados contra personas que participaron en el asalto al Capitolio de Estados Unidos del 6 de enero de 2021, y John Caravello, un profesor en California que fue absuelto de los cargos de haber agredido a un agente federal mientras protestaba una redada migratoria el año pasado.

También impugnan el nuevo fondo la ciudad de New Haven, Connecticut, la Federación Nacional del Aborto y Common Cause, un grupo de vigilancia que con frecuencia cuestiona medidas controvertidas del Gobierno de Trump.

La demanda llega dos días después de que agentes de policía actuales y retirados en Washington que defendieron el Capitolio de Estados Unidos durante el asalto demandaran para bloquear la implementación del fondo, argumentando que potencialmente podría usarse para pagar a personas que participaron en el asalto y financiar diversas organizaciones paramilitares en el país, ambas cosas que, de acuerdo con ellos, serían ilegales.

El fondo anunciado el lunes surgió de un acuerdo extraordinario alcanzado entre el Gobierno y Trump, uno de sus hijos adultos y la Organización Trump en una demanda que presentaron en enero por la divulgación no autorizada de la información fiscal de Trump hace años.

El fondo, que será administrado por cinco comisionados seleccionados por el secretario de Justicia, revisará reclamaciones presentadas por personas que dicen haber sido atacadas injustamente por administraciones anteriores. La enorme bolsa de dinero proviene del Fondo de Sentencias del Departamento de Justicia, que es dinero de los contribuyentes reservado por el Congreso para acuerdos monetarios que el Gobierno alcanza.

En la nueva demanda, los demandantes impugnan específicamente la decisión del Gobierno de Trump de recurrir al Fondo de Sentencias para el nuevo programa, argumentando que es ilegal porque el caso legal subyacente carecía de “mérito” dado el papel único del presidente como demandante y, al mismo tiempo, las agencias del Poder Ejecutivo que fueron nombradas demandadas en la demanda.

“Este más reciente intento del Gobierno Trump-Vance de hacer grande de nuevo el saqueo es profundamente ilegal y no resistirá el escrutinio judicial”, dijo Skye Perryman, presidenta y directora ejecutiva de Democracy Forward y una de las abogadas que presentó la demanda. “Esta demanda trata de proteger el estado de derecho y evitar un abuso peligroso del poder gubernamental, y seguiremos compareciendo ante los tribunales para exigir responsabilidades a este Gobierno”.

El nuevo fondo ha recibido críticas de los demócratas e incluso de algunos miembros del propio partido de Trump, y los republicanos del Senado dijeron esta semana que los tomó por sorpresa y que están divididos sobre cómo ponerle freno, informó CNN.

Freed Gaza flotilla activists accuse Israeli forces of sexual violence and abuse while in custody

(CNN) — Activists on board a humanitarian flotilla intercepted by Israeli forces on their way to Gaza say they were subjected to beatings, torture and sexual violence while in detention.

The Global Sumud Flotilla, carrying 428 passengers along with food, medicine, and humanitarian supplies for civilians in Gaza, was intercepted over the course of several days after departing Turkey, with the final interception on Tuesday.

The group was detained before being deported to Turkey and their alleged treatment has already triggered international backlash.

The Israel-based human rights organization Adalah, which represents the flotilla activists, told CNN that its lawyers documented testimonies from participants who said they were attacked with tasers and rubber bullets and had been subjected to beatings that left them with suspected broken bones. A statement from the Global Sumud Flotilla added that activists had been subjected to sexual violence, including “multiple accounts of rape,” including “forcible penetration by a handgun.”

The Israel Prison Service told CNN that the “allegations raised are false and entirely without factual basis,” and that it “operates in accordance with the law.”

Adalah’s international advocacy coordinator Miriam Azem stood by the allegations. “In the past 10 years of Adalah representing activists on flotillas, this is by far the most severe violence and assaults that we’ve encountered,” she told CNN.

Adalah said they would let the activists who said they had experienced sexual violence speak for themselves. This was because some survivors did not want to go into detail about their assaults, Azem said, while others were still in Israeli detention at the time they spoke with Adalah, and feared repercussions.

Australian film maker and activist Juliet Lamont told CNN that she was beaten and sexually assaulted by five men in a shipping container on board what she called an Israeli “prison boat.”

Speaking Thursday to reporters at Istanbul Airport while she was still wearing the grey prison tracksuit issued by the Israel Prison Service (IPS), Lamont said she believes activists were targeted in a “relentless” and “planned campaign of violence” that she believes is intended to ensure activists do not return.

“You know they’ve broken our bones, but they haven’t broken our soul,” Lamont said.

The IPS told CNN that it “rejects generalized allegations aimed at portraying systematic unlawful conduct.”

“All prisoners and detainees are held in accordance with the law, with full regard for their basic rights and under the supervision of professional and trained prison staff,” the IPS said.

“Any specific complaint or allegation raised through the appropriate legal and official channels is examined by the competent authorities in accordance with applicable procedures,” the IPS said.

Speaking to Australian reporters from a hospital in Istanbul, Australian national Zack Schofield described what he called “a constant barrage of violence” and “brutality” while in detention.

“I myself was zip-tied in a torture position with my hands behind my back, for 40 minutes until I almost vomited from the pain. Then I had my head slammed into the table during the immigration process, constant knees to the chest, face, any kind of way they could there were pliers in my ears pulling them back,” he said, adding that he saw other people “chokeslammed” into the ground.

In other video testimony from activists filmed at the Istanbul Airport on Thursday, flotilla activists described similar forms of severe mistreatment in custody.
