Lawyers for suspected gunman at press dinner agree to keeping him in jail before trial

(CNN) — Lawyers for Cole Tomas Allen — the 31-year-old California man accused of attempting to kill President Donald Trump at Saturday’s White House Correspondents’ Association Dinner — agree that their client should remain in jail ahead of trial.

The hearing began just after 11 a.m. ET and Allen appeared in orange prison scrubs.

“We had difficulties meeting with Allen over the past couple of days,” one of Allen’s lawyers said, noting they have finally met with him. “We are conceding detention.”

Lawyers for Allen previously filed a memo indicating they would dispute his detention. Despite Allen’s team agreeing to detention Thursday, prosecutors still asked a judge to present their case on why he should be held.

“I’m denying the government’s request,” the judge said. “It’s truly unprecedented.”

Prosecutors filed a detention memo Wednesday saying there are “no combination of conditions that will reasonably assure the community’s safety” if Allen were to be released, pointing to his extensive preparations ahead of the dinner as well as the possibility that he could have killed people and inflicted serious damage.

They called his plot one of “extreme political violence.”

“Attempted murder is always a serious crime, but when the intended victim is the President of the United States, as well as other high-ranking members of the U.S. government, the potential consequences are far reaching,” the memo said.

Lawyers for Allen, however, had previously pushed back — opposing detention in their own memo to the judge. The lawyers questioned whether prosecutors have direct evidence of their claims, particularly the allegation that Allen fired his shotgun in the direction of a Secret Service officer on Saturday evening.

“The government’s evidence of the charged offense – the attempted assassination of the president – is thus built entirely upon speculation,” they wrote in a filing arguing for his release ahead of trial.

Prosecutors could point to a note Allen reportedly sent to family members outlining how he wanted to target administration officials, his social media posts and any other material that points to his potential motivation.

Another key issue in the early days of the case has been whether Allen fired his shotgun and hit the Secret Service officer who fired at the man several times and missed.

Defense attorneys have questioned whether prosecutors know if Allen fired his weapon and whether he struck the Secret Service officer.

DC US Attorney Jeanine Pirro, whose office is leading the prosecution of Allen, told Fox News on Thursday morning that Allen “fired that gun in the direction of the Secret Service officer.”

Pirro noted the officer fired five times and investigators have “found five areas consistent with being hit by a nine millimeter,” which is the service weapon officers are equipped with.

“So this Secret Service agent did not shoot himself,” Pirro concluded.

According to prosecutors, Allen traveled by train from California to Washington, DC, in the days prior to Saturday night’s event and stayed at the same hotel the dinner took place.

He was arrested before he made it into the dinner, which was on a different floor.

El presidente Donald Trump afirmó que ABC “haría bien” en despedir pronto a Jimmy Kimmel. Este es el ataque más reciente contra la cadena y su popular presentador de programas nocturnos.

Trump escribió en Truth Social este jueves por la mañana: “¿Cuándo despedirá la cadena de noticias falsas ABC al pésimo Jimmy Kimmel, que dirige de forma incompetente uno de los programas con menor audiencia de la televisión? La gente está enfadada. ¡Más vale que sea pronto!”.

Trump se equivoca sobre los índices de audiencia de Kimmel, pero tiene razón en que los influencers mediáticos de MAGA siguen enfadados con el comediante y con el apoyo que ABC le brinda.

La empresa matriz de ABC, Disney, no ha dado muestras de ceder a pesar de la presión de Trump y del desafío casi sin precedentes que la Comisión Federal de Comunicaciones de EE.UU. (FCC, por sus siglas en inglés) ha planteado a las licencias de las estaciones de ABC.

Disney se ha negado a comentar sobre las peticiones de despido de Kimmel, cuyo contrato finaliza el próximo año. Sin embargo, la compañía ha mantenido su programa nocturno al aire y no ha hecho nada para distanciarse de él.

Trump lleva años arremetiendo contra Kimmel, pero esta última controversia comenzó la semana pasada cuando Kimmel bromeó diciendo que la primera dama, Melania Trump, parecía una “futura viuda”.

El martes, la FCC, afín a Trump, le ordenó a Disney que iniciara un proceso de renovación anticipada para sus ocho licencias de estaciones de ABC, una medida ampliamente considerada como una forma de castigo gubernamental.

Si bien el organismo regulador afirmó que la impugnación de la licencia estaba relacionada con una investigación en curso sobre las iniciativas de diversidad, equidad e inclusión de Disney, la mayoría de los observadores externos lo han interpretado como una represalia por la negativa de ABC a despedir a Kimmel.

Disney declaró este martes que sus estaciones de ABC cumplen con las normas de la FCC y que defenderá las estaciones a través de los “canales legales apropiados”.

La publicación de Trump del jueves sugiere que quiere mantener la presión contra Kimmel y ABC.

Según los expertos legales, es altamente probable que Disney prevalezca en cualquier batalla legal relacionada con sus licencias de emisión.

Kimmel no ha hecho referencia a la batalla de la FCC en sus monólogos de esta semana, pero ha continuado con los comentarios anti-Trump que su audiencia espera.

Se espera que el gobernador de Louisiana, Jeff Landry, suspenda al menos algunas contiendas de las primarias del 16 de mayo en su estado tras la decisión de la Corte Suprema de EE.UU. que invalida el mapa congresional estatal y lo considera una manipulación inconstitucional de distritos electorales.

La votación anticipada para las primarias está programada para comenzar este sábado y las papeletas para votantes en el extranjero ya fueron enviadas. Pero el representante demócrata Cleo Fields, cuyo distrito está en el centro de la decisión de redistribución electoral de la Corte Suprema, dijo que Landry le comunicó que anticipa emitir un decreto para suspender la elección y convocar una nueva.

Fields dijo a CNN que espera una impugnación judicial contra la medida, reportada primero por The Washington Post.

“La gente ya votó”, dijo Fields. “Ya se han enviado papeletas anticipadas”.

Trump says ABC had ‘better’ fire Kimmel as Disney stands firm

(CNN) — President Donald Trump says ABC had “better” fire Jimmy Kimmel soon, in his latest broadside against the network and its popular late-night comedian.

Trump posted to Truth Social on Thursday morning, “When is ABC Fake News Network firing seriously unfunny Jimmy Kimmel, who incompetently presides over one of the Lowest Rated shows on Television? People are angry. It better be soon!!!”

Trump is wrong about Kimmel’s ratings, but he is right that MAGA media influencers remain angry about the comedian and ABC’s support for him.

ABC’s parent company Disney has shown no sign of wavering despite Trump’s pressure and the FCC’s almost unprecedented challenge to ABC’s station licenses.

Disney has declined to comment on the calls to fire Kimmel, who is under contract through next year. But the company has kept his late-night show on the air and has not done anything to distance itself from him.

Trump has railed against Kimmel for years, but this latest controversy began last week when Kimmel made a joke about First Lady Melania Trump looking like an “expectant widow.”

Pro-Trump media outlets condemned the comment, especially in the wake of Saturday night’s shooting outside the White House Correspondents’ Dinner.

On Monday morning, the first lady called on ABC to “take a stand,” and the president followed up that afternoon by saying ABC “should” fire Kimmel immediately.

Then, on Tuesday, the Trump-aligned FCC ordered Disney into an early renewal process for its eight ABC station licenses — a move widely seen as a form of government punishment.

While the regulatory agency asserted that the license challenge was related to an ongoing probe of Disney’s DEI initiatives, most outside observers have viewed it as retaliation for ABC’s refusal to fire Kimmel.

Disney said on Tuesday that its ABC stations are in compliance with FCC rules and that it will defend the stations through the “appropriate legal channels.”

Thursday’s follow-up post from Trump suggests he wants to keep up the pressure against Kimmel and ABC.

Legal experts say Disney will almost certainly prevail in any legal battle over its station licenses.

Kimmel has not referenced the FCC battle in his monologues this week, but he has continued the anti-Trump commentary that his audience expects.

On Wednesday night’s episode, he quipped that “Donald and Melania lately have seemed closer than ever, and I like to think I played a part in that.”

The Trump administration’s rhetoric and the FCC action against ABC have been widely condemned by free expression groups and First Amendment advocates.

“Melania Trump has every right to say Jimmy Kimmel’s joke was vile,” Greg Lukianoff, president of the Foundation for Individual Rights and Expression, said Thursday. “The First Amendment problem starts when the White House pressures ABC to punish a comedian for protected speech. That’s jawboning. And we’ve unfortunately seen this many times before.”
